The president can't do a thing about it so I'm not sure it matters what he wants. Maybe he's trying not to talk about it since congress only seems to want to do the opposite of what he wants.

ViktorEllisson some of that stuff he's asking isn't feasible, but some is very important. The mental health stuff and the changes to the laws to allow mental health issues to show up in NCIC checks
across all 50 states. VERY IMPORTANT.
background checks for private sales - I'm not gonna cry if that happens. If it does - it's not an issue.
i'd prefer it not, but hey. But some of the other things just won't do anything and haven't when they are implemented in some states currently (10 round magazine etc)

He can issue presidential whatevers he's been doing but those don't mean anything at all. They aren't law.
At this point, on a federal level there's laws. But each state has their own system, which must comply with federal law but can add additional checks/etc
for example - IL requires you to have a firearms ownership license. Which requires a background check to get. (and some other stuff just trying to give a gist here)
so in oder to purchase a gun in IL you must have that license PLUS do the federal form 4473 + background check the FFL will do
in Virginia we have 2 databases. NCIC (federal) and VCIN which is Virginias. You connect through NCIC only through the state police VCIN network. So many times people in VA say they are
checking 'VCIN' - it leads people to believe we don't check NCIC, but it's inclusive, so anywya, our VCIN network keeps Temporary Detaining Orders for mental health evaluations
if you have one of those - you cannot purchase a gun. That's not a federal law, that's a state law. (that was put in after VA Tech massacre)
anyway, that's why the president can't really do shit, he can urge, he can counsel, he can whatever, but congress has to do the heavy lifting to make it federal, otherwise, states can act accordingly
And I think that is why it is making it a little difficult. States can require a firearms ownership license like IL does- why does it have to be federal? Again, that's not my belief that's what I think

I'm really ok with mental health clearances to own guns. It won't stop all the problems, but there are some people who I wonder why they were able to buy one. I'd rather the states be making the laws, fwiw.
MaudelineKranfel: that's how I feel. And even though I am libertarian I'm frankly ready to allow psychiatrists treating patients to allow a judge to remove their ability to purchase/own guns if they have
a legitimate reason. I'm not going to appreciate it, but frankly, crazy people shouldn't own guns. PERIOD. And they can petition the judge to obtain their rights back - I don't want it to be like felons
where they have to petition the governor- those are blanket accepts
a judge needs to review the evidence and make a decision. It's going to cause some strain on the system.
I also believe that we need to expand the TDO denial that VA has to all the states. Period. FBI has been on virginia's ass to remove VCIN, but our state police has refused because the FBI won't
keep those TDO records for us (and also our domestic violence denials)
So that's another thing, I don't think it's nationwide to keep the domestic violence charges and protective orders that Virginia keeps too. I'm an FFL, and for every state there's a 300 page book to read
so I know VA the best... because I just don't ship or sell guns outside of my state to avoid getting arrested.
(meaning if i don't follow all the states particular rules I will get arrested..so I just don't do it.)
also, it's fairly common that if a person is ECO'ed to the emergency room for mental health issues (eco is not the same as TDO) and after a certain amount of time the judge cannot just issue a TDO
and get that person help. Instead what they do is say "Sorry there's no bed for you, so you can go home, and take care of yourself"
if a person is sick enough to have the police escort them to the hospital because they are going to hurt themselves or others and there's no room for them then ROOM NEEDS TO BE FOUND.
that's gotta change too- but that's not a gun issue, btu that is an issu ethat i sgoing to HELP people... I think it's very important.
My friends here cannot comprend how states can have laws that aren't 'federal'. Mind blown.
